Terms and Conditions

1. About City Fable

City Fable (“we”, “us”, “our”) offers GPS-based outdoor mystery and escape-room experiences (“Games”) set in locations across Australia. These Terms govern your purchase and use of a team licence (“Licence”) through our online store at cityfable.com.au (“Store”) and the companion mobile application (“App”).

2. Eligibility

By purchasing a Licence you confirm that you are at least 18 years old, or are purchasing with the consent of a parent or legal guardian. You must provide accurate billing and contact information at the time of purchase.

3. Licences and Invite Codes

Each Licence grants a single team of up to six (6) players the right to play one Game once. On purchase you will receive a unique invite code by email. The team leader redeems this code in the App to begin the Game. A Licence is non-transferable and may not be resold. Sharing your invite code outside your intended play group is not permitted.

4. Activation and Access

A Licence is considered activated when the invite code is redeemed in the App and the first chapter is unlocked. We reserve the right to retire or modify Games; where a Game is retired we will provide reasonable notice and offer affected customers a replacement or refund.

Each licence key grants one complete playthrough of the game experience for your group.

Licences are valid for 24 months from the date of purchase. Within this period, your group may pause and resume the game any number of times from the last completed chapter.

Once the final chapter is completed, the licence expires and the experience cannot be replayed using the same key. Groups wishing to replay the experience may purchase a new licence.

If your licence expires mid-game due to the 24-month limit, contact us at hello@cityfable.com and we will extend your licence at no charge.

5. Gameplay Requirements

Games require a compatible smartphone with location services enabled, an active internet connection, and physical presence at the relevant locations. You are responsible for your own safety and the safety of your group during gameplay. City Fable accepts no liability for injury, loss, or damage arising from participation in a Game.

6. Intellectual Property

All content within the Store and App - including story text, puzzles, artwork, audio, and software - is the intellectual property of City Fable or its licensors. You may not reproduce, distribute, or create derivative works from any City Fable content without prior written consent.

7. Prohibited Conduct

You agree not to:

  • Circumvent or tamper with GPS-unlock mechanisms or game logic;
  • Reverse-engineer, decompile, or disassemble the App;
  • Use the App in a way that disrupts other players or third parties;
  • Publish puzzle solutions, codes, or story spoilers without consent.

8. Disclaimer of Warranties

Games are provided “as is”. To the fullest extent permitted by Australian Consumer Law, we exclude all implied warranties. Nothing in these Terms limits any rights you have under the Australian Consumer Law.

9. Limitation of Liability

Where liability cannot be excluded by law, our liability is limited to resupplying the relevant service or refunding the purchase price, at our discretion. We are not liable for indirect, incidental, or consequential loss.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or via the Store. Continued use after the effective date of any update constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Nothing in these Terms limits any rights you may have under the consumer protection laws of your country of residence.

Privacy Policy

1. Who We Are

City Fable operates the Store and App. This policy explains what personal information we collect, why we collect it, how we use it, and your rights.

2. Information We Collect

  • Purchase information - name, email address, and billing details collected at checkout through our payment processor.
  • Account and play data - the invite code redeemed, team composition, chapter completion times, and gameplay progress stored in our database.
  • Location data - GPS coordinates collected by the App during active gameplay only.
  • Device and usage data - App version, operating system, and crash diagnostics collected to maintain service quality.
  • Marketing preferences - email address if you opt in to our mailing list.

3. Location Data

Location data collected during gameplay is used to deliver chapter content, verify gameplay for support and refund purposes, and improve our products. We may analyse aggregated, non-identifiable location patterns to understand how our games are experienced and to inform future game design and marketing. Individual location data is never sold or shared with third parties.

4. How We Use Your Information

  • To fulfil your purchase and deliver your invite code;
  • To operate and improve the Games and App;
  • To respond to support requests;
  • To process refund claims;
  • To send marketing communications (only with your consent);
  • To comply with our legal obligations.

5. Sharing Your Information

We share personal information only where necessary:

  • Stripe - payment processing (subject to their privacy policy);
  • Resend - transactional email delivery;
  • Supabase - database hosting (data stored in Australia or the United States);
  • Legal authorities - where required by law.

We do not sell your personal information to any third party.

6. Data Retention

Purchase and play records are retained for seven years for accounting and support purposes. Location data is retained for 12 months then deleted or anonymised. You may request deletion of your personal data at any time (see “Your Rights” below).

7. Your Rights

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles you have the right to access, correct, or request deletion of personal information we hold about you. To exercise these rights, email us at hello@cityfable.com.

8. Cookies

The Store uses strictly necessary session cookies to manage your login session. No advertising or tracking cookies are used.

9. Children

The Store is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe we have done so inadvertently, please contact us and we will delete it promptly.

10. Changes to This Policy

We may update this policy from time to time. We will notify you of material changes by email or via the Store.

Refund Policy

We want you to feel confident purchasing with City Fable. Below is a clear summary of when refunds apply.

Wrong purchase

Duplicate order, purchased the wrong Game, or similar error - and the Licence has not been activated.

Full refundFlag the error within 48 hours of purchase before activation.

How to request a refund

Email hello@cityfable.com with your order number and a brief description of the issue. We aim to respond within two business days and process approved refunds within five business days.

Australian Consumer Law

Nothing in this policy limits your rights under the Australian Consumer Law. If a product has a major failure you are entitled to choose a refund or replacement.
